This document aims to establish the general terms of use of the mobile application DokiPic (hereinafter referred to as “the Application”), owned by Diego Calvo Jiménez (hereinafter referred to as “the Owner”), NIF 46966689e, with a notification address at Abat Odó 20, 08030 Barcelona.

By using the Application, you agree to comply with these Terms, as well as our Privacy Policy. If you do not agree with any of these terms, please do not use the Application.

In case of any discrepancy with the Spanish version of this document, the Spanish version shall prevail.

1. Acceptance of Terms

By creating an account or using any feature of the DokiPic Application, you agree to comply with these Terms of Use and our Community Guidelines. You acknowledge that we maintain a zero-tolerance policy towards objectionable content and abusive behavior. The use of services offered through DokiPic implies that you are of legal age in your country of residence or that you have the necessary legal consent to use the Application.

2. Service Description

DokiPic is an application that allows users to exchange photos with other people worldwide. Through the Application, users can upload images and share content privately or publicly, including the option to do so anonymously to foster open and creative exchange.

3. Community Guidelines

We are committed to maintaining a safe, respectful, and inclusive environment for all users. To this end, we have established the following guidelines:

Zero Tolerance: We do not tolerate objectionable content, including, but not limited to, illegal, offensive, discriminatory, defamatory, violent, hateful material, or content that infringes on third-party rights. Likewise, abusive behavior, such as harassment, intimidation, bullying, or any form of harmful interaction, is strictly prohibited.
Responsible Use of Anonymity: Our platform allows anonymous posts to encourage creativity and freedom of expression, but we expect all users to use this feature responsibly. Anonymity does not exempt you from complying with these rules or applicable laws.
Consequences: Any user who violates these guidelines will face immediate measures, which may include content removal, temporary suspension, or permanent account ban, depending on the severity of the violation.

By using DokiPic, you agree to adhere to these guidelines and understand that non-compliance will result in enforcement actions by our team.

3.1 Child Safety Policy and CSAE/CSAM Prevention

DokiPic maintains a zero-tolerance policy against any form of child sexual abuse and exploitation (CSAE), child sexual abuse material (CSAM), grooming, sextortion, sexual solicitation of minors, child trafficking, or any content or behavior that exploits, abuses, endangers, or may cause harm to minors. It is strictly prohibited to create, upload, share, request, store, distribute, promote, or facilitate any content or activity related to CSAE or CSAM within DokiPic. Users may report within the application any content, photo, user, or behavior that may pose a risk to child safety, including sexual, illegal, abusive, violent, or suspicious content. When DokiPic becomes aware of content or behavior related to CSAE, CSAM, or any serious risk to child safety, we will take appropriate measures, including removal of the content, restriction or termination of accounts where appropriate, retention of relevant information where legally required, and reporting to the competent authorities. In cases of confirmed CSAM or serious risk to a minor, DokiPic may report the case to law enforcement, the relevant regional authority, an INHOPE member hotline where applicable, or the National Center for Missing and Exploited Children (NCMEC) CyberTipline where appropriate. 4. Use of User Content

DokiPic does not claim ownership rights over the photos or content you upload (hereinafter, “User Content”). You retain all rights to your Content, although by uploading it to the Application, you grant us a limited, non-exclusive, worldwide, royalty-free, and revocable license to use, store, and display such content solely for the operation of the service, including moderation and distribution based on your privacy preferences. We will not use, transfer, or sell User Content to third parties for commercial or advertising purposes without your explicit consent.

5. Content Moderation

To ensure compliance with our Community Guidelines and provide a safe environment, we employ a robust moderation system that includes:

Artificial Intelligence Moderation: We use advanced artificial intelligence to automatically analyze and filter objectionable content in both text and images before it is published. This system is designed to detect and prevent the dissemination of inappropriate material, such as offensive language, hate speech, explicit content, or images that violate our policies.
Manual Review: In addition to automated moderation, our team of moderators conducts manual reviews of reported or potentially problematic content, ensuring accuracy and fairness in the application of rules.
Response Time: We commit to reviewing and acting on reports of objectionable content within a maximum of 24 hours. Actions may include immediate content removal and measures against the responsible user, such as warnings, temporary suspension, or permanent expulsion from the platform.
Transparency: Users will be notified if their content is removed or their account is sanctioned.
Privacy in Moderation: Data processed by our moderation system is used solely to maintain a safe community and is not used to train AI models or for other purposes without the user’s explicit consent.

6. Tools for Users

To empower our users in creating a positive and safe community, we offer the following tools directly within the Application:

Content Reports: Users can report a photo if it contains sexual, illegal, or violent content, if it shows nothing, or if they repeatedly receive very similar photos from the same user. A photo cannot be reported simply because you don’t like it or it’s not interesting enough. In such cases, it’s sufficient to send a new photo to receive a different one.
User Blocking: A user can be blocked if their content includes sexual, illegal, or violent elements. Blocking a user because their photos are not interesting is not allowed. Likewise, using the blocking tool for discriminatory purposes is strictly prohibited. It must never be used to exclude users based on reasons such as their gender or location.
Post Removal: Users can immediately remove posts from their personal feed if they consider them inappropriate, unwanted, or irrelevant.

We encourage all users to use these tools responsibly to help us maintain DokiPic as a safe, inclusive, and enriching space for everyone. Improper use of the reporting or blocking tools, such as false reports or discriminatory blocks, may result in penalties for the offending user, including warnings, temporary suspension, or permanent account cancellation.

7. User Obligations

By using DokiPic, you agree to:

Not upload or share content that is illegal, offensive, discriminatory, defamatory, violent, or that infringes on third-party intellectual property rights.
Not use the Application to harass, intimidate, harm, or prejudice other individuals, whether directly or anonymously.
Not engage in fraudulent, deceptive, or manipulative activities that attempt to interfere with the Application’s operation.
Not interfere with the security, integrity, or availability of the Application.
Respect the privacy of other users and not share third-party information or photos without their explicit consent.
Comply with all applicable laws and our Community Guidelines.

We reserve the right to remove any content we deem inappropriate or illegal and to suspend or terminate accounts that violate these rules.

8. Intellectual Property Rights

The Application and all content displayed therein (except User Content) are protected by intellectual property rights, including design, texts, graphics, logos, images, software, and code. These rights are owned by DokiPic or its licensors and may not be used without prior and express authorization.

9. Advertising, Analytics, and Application Improvement

At DokiPic, our goal is to provide you with the best possible experience and continue developing the application. To achieve this and fund its growth, we may include advertising provided by carefully selected third parties. These ads are based on information about your use of the Application, but we always respect your consent preferences and comply with applicable privacy regulations, such as the General Data Protection Regulation (GDPR). Additionally, we use statistical analytics services to understand how users interact with the Application. This data allows us to identify areas for improvement, optimize performance, and create new features that benefit everyone. Whenever possible, data collected for these analytics is aggregated and anonymized to protect your privacy. Both advertising and analytics serve a single purpose: improving the Application. We commit to working with partners who respect user privacy and comply with data protection laws. However, please note that these third-party services have their own privacy policies, and we are not responsible for their practices. You have control: you can manage your consent preferences for advertising and analytics in the Application’s settings at any time. Without your explicit approval, we will not use your data for these purposes.

10. Personal Data Protection and Minimization

We are committed to safeguarding your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable regulations. To this end, we have adopted the following measures:

Data Minimization: We collect only the information strictly necessary for the operation and improvement of the Application.
Anonymization and Pseudonymization: Whenever possible, your data will be anonymized or processed in a way that does not allow direct identification.
Control and Access: You will have clear mechanisms to access, rectify, or request the deletion of your data through the Application.
Security: We implement technical and organizational measures to protect the integrity and confidentiality of your information, preventing its misuse or unauthorized access.
Data Use in Moderation: Data processed by our moderation system, whether by AI or manual review, is handled securely and used solely to ensure compliance with our guidelines. It is not used to train AI models or for other purposes without your explicit consent.

11. Modification of Terms

We reserve the right to modify or update these Terms at any time. If significant changes are made, we will inform you through the Application or by email. Continued use of the Application after the implementation of such changes will imply your acceptance of the new terms.

12. Limitation of Liability

The Application is offered “as is,” and its use is at your own risk. We do not guarantee that it will be available uninterruptedly or free of errors. To the maximum extent permitted by law, we will not be liable for direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Application.

13. Account Termination and Suspension

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, the Community Guidelines, or if there is suspicion of fraudulent activities. Measures may include warnings, temporary suspensions, or permanent bans, depending on the severity of the violation. In case of termination, you will not be entitled to any refund for unused services or purchases.

13.1 Account Inactivity

Accounts that remain inactive for a period longer than three (3) months may be permanently deleted. Inactivity is defined as the absence of access to the Application and/or the lack of use of its main features during that period. As DokiPic is a private service, we reserve the right to manage and remove inactive accounts in order to ensure the proper functioning and sustainability of the platform. Whenever technically possible, we will attempt to notify the affected user in advance via push notification or other means available within the Application. However, the inability to provide such notice will not prevent the deletion of the inactive account.

14. Applicable Law and Jurisdiction

These Terms shall be governed and interpreted in accordance with the current legislation in Spain. Any dispute arising from the use of the Application will be subject to the jurisdiction of the courts of Barcelona.
